KÄYTTÄJÄSOPIMUS

Galleria Henkevä Silakka on virtuaalinen taidegalleria. Gallerian näyttelyitä ja taiteilijatietoja ja -haastatteluja voi katsella ilmaiseksi ja rekisteröitymättä. Rekisteröityneet käyttäjät voivat laittaa teoksiaan esille. Rekisteröityneet käyttäjät saavat tietonsa taiteilijaluetteloon ja voivat itse muokata tietojaan. Rekisteröityminen ja näyttelyihin osallistuminen on ilmaista.

NÄYTTELYSOPIMUS

Galleria Henkevällä Silakalla on oikeus käyttää teoksia esitellessään tai mainostaessaan gallerian toimintaa. Galleria ei saa käyttää teoksia voittoa tuottavaan tarkoitukseen. Teosten tekijänoikeudet säilyvät tekijällä.

Rastittamalla "Olen lukenut käyttäjäsopimuksen" suostut siihen, että:

• Teoksesi on esillä Galleria Henkevän Silakan etusivulla valitun näyttelyn ajan.
• Teokset ja teostiedot jäävät näyttelyn jälkeen Galleria Henkevän Silakan arkistoon ja pysyvät siellä kunnes taiteilija poistaa ne itse. Galleria Henkevä Silakka voi poistaa teoksen arkistosta halutessaan.
• Vaikka teos itse poistettaisiin Galleria Henkevän Silakan arkistosta, arkistoon jää teostietosivu, jossa mainitaan teoksen tekijä, nimi, vuosi ja tekniikka.

Rastittamalla "Olen lukenut käyttäjäsopimuksen" tiedät, että:

• Galleria Henkevä Silakka ei veloita taiteilijalta teosten näyttämisestä, näyttelyistä tiedottamisesta ja muusta galleriatoiminnasta mitään.
• Galleria Henkevä Silakka ei maksa taiteilijalle teosten näyttämisestä mitään. Taiteilija ei voi vaatia Galleria Henkevältä Silakalta mitään korvauksia, jos suostuu näihin ehtoihin ja lähettää teoksensä näyttelyyn.
• Galleria Henkevä Silakka ei toimi teosten myyjänä tai välittäjänä.
• Niin kauan, kun teos on Galleria Henkevän Silakan näyttelyssä tai arkistossa, Galleria Henkevällä Silakalla on esitysoikeus/käyttöoikeus teokseen. Käyttöoikeuden luovutus on ei-yksinomainen (taiteilijalla on sopimuksen voimassaoloaikana oikeus itse toisintaa teosta tai myöntää käyttölupia kolmannelle). Lupa ei anna oikeutta moraalisia oikeuksia loukkaavaan käyttöön. Tekijän ja teoksen nimi on ilmoitettava teosta toisinnettaessa. Teosta ei saa toisintaa muutettuna ilman kirjallista lupaa tekijältä.
• Galleria Henkevä Silakka ei luovuta nimimerkillä toimivien taiteilijoiden yksityistietoja eteenpäin ilman taiteilijan lupaa, ellei kyseessä ole rikokseen, kuten tekijänoikeusrikkomukseen tai teoksen sisällön lainvastaisuuteen, liittyvä pyyntö viranomaistaholta.
• Rekisteröityneenä taiteilijana olet itse vastuussa taiteilija-sivusi sisällöstä ja tiedoista ja tietojen ajankohtaisuudesta ja oikeellisuudesta.

Rastittamalla "Olen lukenut käyttäjäsopimuksen" lupaat, että:

• Teoksissa ei rikota kenenkään yksityissuojaa (teoksissa ei käytetä olemassaolevien henkilöiden nimiä, yhteystietoja tai yksityisessä paikassa otettua kuvaa ilman heidän lupaansa)
• Teoksissa ei esiinny lainvastaista materiaalia. Vastuu teoksen sisällöstä säilyy tekijällä. Galleria Henkevä Silakka EI ota vastuuta, mikäli lisäämäsi työt johtavat oikeustoimiin, korvauksiin tai vastaaviin toimenpiteisiin.

JULISTEEN LÄHETYSEHDOT

Lähettämällä julisteen luovutat sen säilytys- ja käyttöoikeuden ilmaiseksi Galleria Henkevälle Silakalle. Jos Galleria Henkevä Silakka valitsee julisteen näyttelyjulisteeksi, juliste ja sen lähettämisen yhteydessä välitetyt tiedot jäävät pysyvästi Galleria Henkevän Silakan julistearkistoon. Galleria Henkevä Silakka saa rajattoman esitysoikeuden julisteeseen, mutta ei saa hyötyä julisteesta rahallisesti. Galleria Henkevä Silakka mainitsee julisteen suunnittelijan nimen aina julisteen käyttämisen yhteydessä.

USER CONTRACT

The Gallery Spirited Herring is a virtual online art gallery. You can view the exhibitions and artist files of the gallery for free and without registration. Registrated users may take part to the exhibitions by sending their artwork. Registered users can have their artistic information in artist listing and may update/change the information in their personal pages by themselves. Registration and taking part to the exhibitions is free of charge.

EXHIBITION CONTRACT

The Online Art Gallery Spirited Herring may use the submitted artworks in the gallery activities demonstrations and advertising. The Online Art Gallery Spirited Herring may not use the submitted artworks to make financial profit. The copyrights of the submitted artwork will remain with the original artist.

By choosing "I've read the user contract" you agree to:

• Your artwork is exhibited in The Online Art Gallery Spirited Herring during the exhibition you've chosen.
• After the exhibition the artwork and artwork information are archived into The Online Art Gallery Spirited Herring database until the artists removes the artwork. The Online Art Gallery Spirited Herring may remove the artwork any time.
• Even if the artwork is removed from the The Online Art Gallery Spirited Herring database, the artwork information page with the information about artist, name of the artwork, year and technique will remain in The Online Art Gallery Spirited Herring archives.

By choosing "I've read the user contract" you know that:

• The Online Art Gallery Spirited Herring doesn't charge artist for exhibiting the artworks, informing about exhibitions and other gallery activities.
• The Online Art Gallery Spirited Herring doesn't pay artist anything for exhibiting the artworks. The artist can't demand any payment/charges for The Online Art Gallery Spirited Herring if he/she accpets this contract and submits his/her artwork to the exhibition.
• The Online Art Gallery Spirited Herring doesn't sell or supply any artworks.
• As long as the artwork exists in the exhibitions or archives of The Online Art Gallery Spirited Herring, the gallery has a right to exhibit and use the artwork for non-commercial purposes. This doens't restrict artist in any way: artist may use copies of his/her artwork and give permissions to show the artwork for a third party. The name of the artist and the name of the artwork is mentioned when the artwork is exhibited The artwork may not be copied without written permission from the artist.
• The Online Art Gallery Spirited Herring doesn't reveal the personal information of the artists using nickname or artist name without the permission of the artist unless there is a strong doubt of the crime (such as violation of copyrights or the criminal content of the artwork).
• As a registered artist you are responsible of the rightness of the content of your persnal artist page.

By choosing "I've read the user contract" you promise that:

• There is no violation of any person's privacy (there are no names, contact information or photos taken in private premises of the existing person, without the authorisation of that particular person)
• The artwork doesn't contain any illegal material. Responsibility of the contect is with the artist. The Online Art Gallery Spirited Herring won't take any responsibility if the artwork you submit will cause legal actions, reclamations or any such actions.

TERMS FOR SENDING THE POSTER

By sending the poster you give The Online Art Gallery Spirited Herring a permanent right to archive the poster and to use the poster for free of charge. If The Online Art Gallery Spirited Herring will select the submitted poster as one of the exhibition posters, the submitted poster and the information submitted with it will remain permanently in the poster archive of The Online Art Gallery Spirited Herring. The Online Art Gallery Spirited Herring will have a unlimited right to exhibit the poster but the gallery may not gain any financial profit by using it. The Online Art Gallery Spirited Herring will mention the designer of the poster every time the poster is used.
